1. AGREEMENT TO TERMS
These Terms of Service constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you"), and Local Guide Tools ("we," "us," or "our"), concerning your access to and use of the http://www.localguidetools.com website as well as any other media form, media channel, or mobile website related, linked, or otherwise connected thereto (collectively, the "Site").
By accessing the Site, you agree that you have read, understood, and agreed to be bound by all of these Terms of Service. If you do not agree with all of these Terms of Service, then you are expressly prohibited from using the Site and you must discontinue use immediately.
2. NO AFFILIATION WITH GOOGLE LLC
Local Guide Tools is an independent, third-party web application. We are not affiliated, associated, authorised, endorsed by, or in any way officially connected with Google LLC, Google Maps, the Google Local Guides program, or any of their subsidiaries or affiliates. The official Google Maps website can be found at https://www.google.com/maps. The name "Google", "Google Maps", "Local Guides", as well as related names, marks, emblems, and images are registered trademarks of their respective owners. Our Site utilises the public Google Maps Platform APIs to provide our tools, and your use of our Site is also subject to the Google Maps/Google Earth Additional Terms of Service.
3. USE OF THE SERVICES AND USER RESPONSIBILITIES
Our Site provides tools to help independent contributors find incomplete data on Google Maps. By using our tools, you agree to the following:
- You will only submit accurate, helpful, and truthful contributions (photos, reviews, edits) to Google Maps.
- You will not use our tools to spam businesses, leave fake reviews, upload irrelevant photos, or harass local businesses.
- You will strictly adhere to the official Google Maps User Contributed Content Policy and the rules of the Google Local Guides program.
- We are not responsible if your Google account is suspended, penalised, or removed from the Local Guides program due to your contributions.
4. INTELLECTUAL PROPERTY RIGHTS
Unless otherwise indicated, the Site is our proprietary property. All source code, databases, functionality, software, website designs, audio, video, text, photographs, and graphics on the Site (collectively, the "Content") are owned or controlled by us, and are protected by copyright and trademark laws. The Google Maps interface, map data, place data, and imagery displayed through our tools are the property of Google LLC and its data providers.
5. THIRD-PARTY WEBSITES AND CONTENT
The Site may contain links to other websites ("Third-Party Websites") as well as articles, photographs, text, graphics, pictures, designs, video, information, applications, software, and other content belonging to or originating from third parties. We are not responsible for any Third-Party Websites accessed through the Site.
Advertisers: We allow advertisers to display their advertisements and other information in certain areas of the Site. We simply provide the space to place such advertisements, and we have no other relationship with advertisers.
Donations: We may provide a link to third-party platforms (such as Ko-fi) for users who wish to voluntarily support the Site financially. Any transactions made through these platforms are subject to the terms and conditions of those specific third-party services.
6. SITE MANAGEMENT AND MODIFICATIONS
We reserve the right, but not the obligation, to:
- Monitor the Site for violations of these Terms of Service.
- Take appropriate legal action against anyone who, in our sole discretion, violates the law or these Terms of Service.
- Modify, suspend, or remove the Site or any of its tools at any time or for any reason without notice (including if changes to third-party API pricing or availability make it unfeasible to continue offering the tools for free).
7. DISCLAIMER OF WARRANTIES
THE SITE IS PROVIDED ON AN AS-IS AND AS-AVAILABLE BASIS. YOU AGREE THAT YOUR USE OF THE SITE AND OUR SERVICES WILL BE AT YOUR SOLE RISK. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, IN CONNECTION WITH THE SITE AND YOUR USE THEREOF.
We make no warranties or representations about the accuracy or completeness of the site’s content or the data provided by third-party APIs. We assume no liability or responsibility for any (1) errors, mistakes, or inaccuracies of data (including unconfirmed accessibility data or photo counts), (2) personal injury or property damage resulting from your use of the site or your physical visits to locations found via the site, or (3) any interruption or cessation of transmission to or from the site.
8. LIMITATION OF LIABILITY
IN NO EVENT WILL WE OR OUR DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY DIRECT, INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFIT, LOST REVENUE, LOSS OF DATA, OR OTHER DAMAGES ARISING FROM YOUR USE OF THE SITE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
9. GOVERNING LAW
These Terms shall be governed by and defined following the standard principles of law. You and Local Guide Tools agree that the courts shall have exclusive jurisdiction to resolve any dispute which may arise in connection with these terms.
10. CORRECTIONS
There may be information on the Site that contains typographical errors, inaccuracies, or omissions, including descriptions, pricing, availability, and various other information. We reserve the right to correct any errors, inaccuracies, or omissions and to change or update the information on the Site at any time, without prior notice.
